In March 2018, the World Trade Organization (WTO) issued a notice from Ukraine, announcing and adopting the draft Cabinet Resolution adopted on February 28, 2018, approving the technical regulations on toy safety (draft technical regulations [1]) .
Attached to the WTO document, document number 18-1904 [3], and notified under the G / TBT / N / UKR / 120 / Add.1 rules of new technology regulations [2] will repeal the Cabinet Order of Ukraine in July 2013 No. 515 "Technical Regulations for Toy Safety" [4] (Official Gazette of Ukraine, No. 61, 2013, item 2192) formulated on the 11th of October. This regulation reviewed a provision in Directive 2009/48 / EC, also known as the "European Toy Safety Directive" (TSD), but this technical regulation has not been revised since it was adopted.
The safety requirements of the new technology regulations are similar to the latest children ’s toy safety directives, especially including the following:
The obligations of operators (manufacturers, authorized representatives (AP), importers and distributors), including consideration of applying the obligations of manufacturers to importers and distributors
Before launching a toy to the market, the safety assessment of the toy must be completed. The risk factors that need to be analyzed include: chemical analysis, physical, mechanical, electrical, flammability, hygiene, radioactivity and other potential exposure risks of toys
Use conformity assessment procedures in accordance with national standards to demonstrate compliance with all safety requirements or inspection procedures in the list of national standards
Require manufacturers to draft technical documents containing the information in Annex 4
Relevant departments are required to carry out market supervision activities
The warning message is required to be clear and easy to read, easy to understand and accurately marked on the toy, attached label or outer packaging. The warning message can be directly attached to the small toy without packaging
Require compliance toys to be launched on the market to carry a compliance mark
Provide a list of products that are not considered toys
